「華爾街日報」指出，參議院司法委員會正準備一個快速的時程，趕在11月3日大選前通過巴瑞特的大法官人事。巴瑞特的加入，牽動美國聯邦最高法院今後幾十年整個倒向保守派。司法委員會可能在10月10日當週安排聽證，10月26日前完成全院表決通過她的人事案。美國聯邦最高法院即將要面臨的關鍵大戰，就是大選後一週要處理俗稱「歐記健保」的平價醫療法（Affordable Care Act）的命運。
