 國際飲料協會關於飲料包裝瓶蓋的規定Regulations of the International Council of Beverages Associations on the Beverage Packaging Caps

(芝加哥時報快訊)鑒於全球對塑膠廢棄物問題的高度關注以及推動可持續發展的迫切需求,國際飲料協會(ICBA)決定,到2026年底,全球飲料瓶蓋將全面實現環保化。為減少飲料包裝廢棄物對環境的影響,並確保飲料行業在包裝設計和使用方面符合環保要求,特製定以下規定。

 一、適用範圍

這些規定適用於全球所有成員企業生產和銷售的飲料產品所使用的塑膠瓶包裝,包括但不限於各種瓶裝水、碳酸飲料、果汁飲料、茶飲料、功能飲料等。

二、具體規定

(一)瓶蓋與瓶體的連接方式

1. 從2026年12月31日起,新設計和生產的塑膠瓶包裝必須採用使瓶蓋與瓶體不可分離的連接方式,確保在正常使用和回收過程中瓶蓋始終與瓶體相連。

2. 連接方式應具有足夠的牢固度,有效防止瓶蓋在飲料產品的整個生命週期(包括生產、運輸、儲存、銷售和消費者使用)中意外脫落或分離。同時,連接方式不應妨礙消費者正常開啟和關閉瓶蓋,以確保良好的用戶體驗。

(二)標籤要求

1. 企業需要在採用不可分離瓶蓋設計的塑膠瓶包裝的顯著位置標注清晰易懂的標籤,說明瓶蓋與瓶體的不可分離特性以及正確的使用方法,引導消費者正確處理包裝廢棄物。

2. 標籤應包括國際認可的回收標誌和相關文字說明,如“請保持瓶蓋與瓶體相連以便回收”等。具體文字語言應根據銷售地區的語言要求進行調整,以確保消費者理解。

(三)過渡期

1. 對於現有的採用可分離瓶蓋設計的塑膠瓶包裝庫存,企業可以繼續銷售和使用至2026年12月30日。從2026年12月31日起,市場上不應再有新的採用可分離瓶蓋設計的包裝飲料產品。

2. 在過渡期內,企業應積極調整生產計畫,逐步減少可分離瓶蓋包裝的生產,並加大不可分離瓶蓋包裝的研發、生產和推廣力度。

 

(四)豁免條款

1. 在某些特殊情況下,如出於醫療或安全原因(如特定的藥用飲料包裝),經國際飲料協會審核批准後,企業可暫時豁免執行這些規定,但應積極尋求替代解決方案,儘快滿足環保要求。

2. 對於因技術原因暫時無法實現瓶蓋與瓶體不可分離設計的小型企業或特定地區的企業,協會將根據實際情況提供一定的技術支持和寬限期,幫助其逐步達到監管要求。

(五)監督與執行

1. 國際飲料協會將建立專門的監督機制,定期檢查成員企業的包裝設計和使用情況。檢查方式包括但不限於企業自查報告、第三方機構檢測、市場抽樣調查等。

2. 對於違反這些規定的成員企業,協會將採取相應的懲罰措施,包括但不限於警告、罰款、限制會員權益等。具體懲罰措施將根據違規的嚴重程度確定。同時,協會將定期公佈違規企業名單,促使企業自覺遵守規定。

(六)技術創新與合作

1. 鼓勵成員企業積極開展技術創新,研發更環保、高效的瓶蓋與瓶體連接技術和材料,提高包裝的可回收性和可持續性。

2. 協會將推動成員企業之間以及與其他相關行業的合作,共同分享技術創新成果,促進整個產業鏈的綠色發展。例如,組織技術交流研討會、聯合研發專案等。

(七)消費者教育與宣傳

1. 成員企業應通過產品包裝、官方網站、社交媒體、廣告等管道積極開展消費者教育活動,向消費者宣傳瓶蓋與瓶體不可分離設計的環保意義以及正確處理包裝廢棄物的方法,提高消費者的環保意識和參與度。

2. 協會將統一制定消費者教育和宣傳材料範本,供成員企業參考使用,以確保宣傳資訊的準確性和一致性。同時,協會將組織大規模的環保宣傳活動,提高公眾對飲料包裝環境問題的關注度。

(八)與其他環保法規的協調

1. 這些規定應與其他國家和地區的相關環保法規和政策保持一致。成員企業在執行這些規定的同時,應確保遵守當地法律法規,避免衝突。

2. 協會將密切關注全球環保法規的動態變化,及時調整和完善這些規定,確保成員企業始終處於環保合規的前沿。

 

(九)報告與回饋

1. 成員企業應定期向國際飲料協會報告瓶蓋與瓶體不可分離規定的執行進展情況,包括生產調整計畫、技術研發成果以及消費者教育活動的開展情況等。報告格式應按照協會規定的範本和要求提交。

2. 協會將及時收集成員企業的回饋,對規定執行過程中遇到的問題進行研究分析,並提供相應的解決方案和指導。同時,鼓勵成員企業積極提出改進建議,共同完善這些規定。

(十)違規處理申訴機制

1. 如果成員企業對違規處理結果有異議,有權向國際飲料協會提出申訴。申訴應在收到違規處理通知後的[規定申訴期限]內以書面形式提交,並應包括申訴理由的詳細說明和相關證據。

2. 協會將設立專門的申訴處理委員會,對申訴進行公正、客觀的審查。申訴處理委員會將根據審查結果作出維持、變更或撤銷原處理決定的裁決,並及時通知申訴企業。

這些規定自頒佈之日起生效,所有成員企業應嚴格遵守並積極落實相關要求,共同為全球飲料行業的可持續發展貢獻力量。

In view of the high global attention to the issue of plastic waste and the urgent need to promote sustainable development, The International Council of Beverages Associations (ICBA) has decided that by the end of 2026, beverage caps worldwide will be fully environmentally friendly The following regulations are formulated to reduce the impact of beverage packaging waste on the environment and ensure that the beverage industry complies with environmental requirements in packaging design and use.

 I. Scope of Application

These regulations apply to the plastic bottle packaging used for beverage products produced and sold by all member enterprises worldwide, including but not limited to various bottled waters, carbonated beverages, fruit juice beverages, tea beverages, functional beverages, etc.

 II. Specific Regulations

 (I) Connection Method of Cap and Bottle Body

1. Starting from December 31, 2026, newly designed and produced plastic bottle packaging must adopt a connection method that makes the cap inseparable from the bottle body, ensuring that the cap remains connected to the bottle body during normal use and recycling processes.

2. The connection method should have sufficient firmness to effectively prevent the cap from accidentally falling off or separating during the entire life cycle of the beverage product, including production, transportation, storage, sales, and consumer use. At the same time, the connection method should not hinder consumers from normally opening and closing the cap to ensure a good user experience.

 (II) Labeling Requirements

1. Enterprises need to mark clear and easy-to-understand labels in prominent positions on the plastic bottle packaging with the inseparable cap design, explaining the inseparable characteristics of the cap and the bottle body and the correct method of use to guide consumers to correctly handle packaging waste.

2. The label should include the internationally recognized recycling symbol and relevant text instructions, such as “Please keep the cap and the bottle body connected for recycling”, etc. The specific text language should be adjusted according to the language requirements of the sales area to ensure consumer understanding.

 (III) Transitional Period

1. For the existing inventory of plastic bottle packaging with separable cap designs, enterprises can continue to sell and use them until December 30, 2026. Starting from December 31, 2026, there should be no new packaged beverage products with separable cap designs on the market.

2. During the transitional period, enterprises should actively adjust their production plans, gradually reduce the production of separable cap packaging, and increase the research, development, production, and promotion of inseparable cap packaging.

 (IV) Exemption Clauses

1. In certain special circumstances, such as for medical or safety reasons (such as specific pharmaceutical beverage packaging), after being reviewed and approved by the International Beverage Association, enterprises may be temporarily exempted from implementing these regulations, but they should actively seek alternative solutions to meet environmental requirements as soon as possible.

2. For small enterprises or enterprises in specific regions that are temporarily unable to achieve the inseparable cap and bottle body design due to technical reasons, the association will provide certain technical support and a grace period according to the actual situation to help them gradually meet the regulatory requirements.

 (V) Supervision and Enforcement

1. The International Beverage Association will establish a dedicated supervision mechanism to regularly inspect the packaging design and use of member enterprises. Inspection methods include, but are not limited to, enterprise self-inspection reports, third-party agency testing, market sampling surveys, etc.

2. For member enterprises that violate these regulations, the association will take corresponding punitive measures, including but not limited to warnings, fines, restricting member rights and interests, etc. The specific punitive measures will be determined according to the severity of the violation. At the same time, the association will regularly announce the list of violating enterprises to promote enterprises to voluntarily comply with the regulations.

 (VI) Technological Innovation and Cooperation

1. Encourage member enterprises to actively carry out technological innovation, research and develop more environmentally friendly and efficient cap and bottle body connection technologies and materials, and improve the recyclability and sustainability of packaging.

2. The association will promote cooperation among member enterprises and with other related industries, jointly share technological innovation achievements, and promote the green development of the entire industrial chain. For example, organize technical exchange seminars, joint research and development projects, etc.

 

 (VII) Consumer Education and Publicity

1. Member enterprises should actively carry out consumer education activities through product packaging, official websites, social media, advertising, and other channels to publicize the environmental significance of the inseparable cap and bottle body design and the correct method of handling packaging waste to consumers, and improve consumers’ environmental awareness and participation.

2. The association will uniformly formulate templates for consumer education and publicity materials for member enterprises to use as a reference to ensure the accuracy and consistency of publicity information. At the same time, the association will organize large-scale environmental publicity activities to increase public attention to beverage packaging environmental issues.

 (VIII) Coordination with Other Environmental Regulations

1. These regulations should be consistent with relevant environmental regulations and policies of other countries and regions. Member enterprises should ensure compliance with local laws and regulations while implementing these regulations to avoid conflicts.

2. The association will closely monitor the dynamic changes of global environmental regulations and timely adjust and improve these regulations to ensure that member enterprises are always at the forefront of environmental compliance.

 (IX) Reporting and Feedback

1. Member enterprises should regularly report to the International Beverage Association on the progress of implementing the regulations on the inseparable cap and bottle body, including production adjustment plans, technological research and development achievements, and the implementation of consumer education activities. The report form should be submitted in accordance with the templates and requirements specified by the association.

2. The association will timely collect feedback from member enterprises, conduct research and analysis on the problems encountered in the implementation of the regulations, and provide corresponding solutions and guidance. At the same time, encourage member enterprises to actively put forward improvement suggestions to jointly improve these regulations.

 (X) Appeal Mechanism for Violation Handling

1. If a member enterprise has objections to the violation handling result, it has the right to appeal to the International Beverage Association. The appeal should be submitted in writing within [the specified appeal period] after receiving the violation handling notice and should include a detailed explanation of the appeal reasons and relevant evidence.

2. The association will establish a dedicated appeal handling committee to conduct a fair and objective review of the appeal. The appeal handling committee will make a ruling to maintain, change, or revoke the original handling decision based on the review results and notify the appealing enterprise in a timely manner.

 

These regulations shall come into effect on the date of promulgation, and all member enterprises should strictly abide by and actively implement the relevant requirements to jointly contribute to the sustainable development of the global beverage industry.
